The case in a nutshell:
DEA agent running behind to surveil a fentanyl dealer speeds and runs through stop signs to try to catch up with his team. Runs over cyclist while running through stop sign.
Defense team argues that there’s urgency based on what the agent knew at the time. Case was moved to federal court specifically to grant immunity against state prosecution.
So, by this logic, the cops that shot the airman in his bed should be tried by a court-martial.
No no. Qualified immunity, my little plebian.
I’m considered an enemy of the state and could be killed by federal agents at any moment.
Good to know.
