    I mean, not that that isn’t true, but isn’t the point of the DMCA that it forces the accused party to (automatically) take action to remove the content even before being able to try have the case lifted up to a court?

    At least that’s how I’ve understood DMCA as a non-US person: a mechanism to skirt court proceedings and have content automagically taken down.

      That is the mechanism of rich corpos and people against poor people. Poor people automatically take it down because they can’t afford to get sued for multi millions. Rich people and companies can just fight it and out-last their opponents in court costs.

      Also not in the US, but that is what someone explained to me about how it usually works.
